AKIBAT HUKUM PUTUSAN MAHKAMAH KONSTITUSI TERHADAP EKSEKUSI JAMINAN FIDUSIA (Analisis Putusan Mahkamah Konstitusi No. 18/PUU-XVII/2019)

This research is to analyze the legal consequences of Constitutional Court Decision No. 18 / PUU-XVII / 2019 on the execution of fiduciary guarantees. The research method used is juridical normative with a legislation approach and case in the form of Constitutional Court decision that have permanent legal force. The results obtained that the legal consequence of the decision was the execution of fiduciary guarantees by the creditor in the event that there is no agreement on default and the debtor objected to voluntarily handing over the object that became fiduciary guarantees, then the legal mechanisms and procedures in the execution of the Fiduciary Guarantee Certificate must go through a district court order.
