Im ersten Kapitel wird unter anderem anhand der Lehren der Kanonisten Gratian, Rufinus von Bologna, Stephanus von Tournai, Huguccio von Pisa die Entwicklung dargelegt, die die Lehre von der Putativehe im Laufe des 12. Jahrhunderts in der Kanonistik nahm. Im zweiten Kapitel erfolgt dieselbe Darstellung für die Ersitzung.
