ماهیت تعزیری ثلث مازاد بر دیه نفس و آثار آن در قانون تغلیظ دیه دوره52 شماره2 سال1399

The holy religion of Islam, in order to protect the social and economic security of secure and holy places and respect their sanctity, has provided special sanctity and holiness for certain times (Dhu al-Qa'dah, Dhu al-Ḥijjah, Muharram, Rajab) and places (Shrine of Mecca and other honored places with differences in opinions) and aggravates or increases the punishment of perpetrators of crimes in these areas in addition to the prescribed religious punishment. If the crime committed is murder, its punishment is “full blood money and one-third” according to a Sahih narration of Imam Sadegh peace be upon him. Throughout the history of Islamic jurisprudence, the individual entitled to receive the one-third surplus has been the one entitled to the blood money itself and this ruling indicates that the Islamic jurists have not considered this extra amount to be of a nature other than the blood money. However, the hypothesis of this article is that the one-third in excess of the blood money has a “Taaziri” nature. In organizing the present research, analysis of texts and Ijtihadi method especially rectifying the effective cause and cancellation of specificity have been used. Proving this hypothesis has several implications the most important of which is the Islamic state's right to receive the one-third in excess of the blood money as one of the Islamic state's financial resources. Amending the relevant articles of the Islamic Penal Code is another expected implication of this theory.شرع مقدس اسلام به منظور صیانت از امنیت اجتماعی و اقتصادی و حفظ حرمت محل‌های امن و مقدس، برخی از زمان‌ها (ماه‌های ذی‌القعده، ذی‌الحجه، محرم و رجب) و مکان‌ها (حرم مکه و سایر مشاهد مشرفه با اختلاف در اقوال) را احترام و تقدسی خاص بخشیده و مجازات مرتکبان جنایت در این پهنه‌ها را افزون بر مجازات مقدر شرعی، تشدید یا تغلیظ می‌کند. اگر جرم انجام شده قتل باشد، مجازات آن بنابر روایتی صحیح از امام صادق (ع) «دیه کامل و ثلث» است. در طول تاریخ فقه اسلام، مستحق دریافت ثلث مازاد، همان مستحق دریافت اصل دیه دانسته شده است و این حکم بیانگر آن است که فقها برای این مقدار زاید، ماهیتی غیر از دیه قائل نبوده‌اند. اما فرضیه این مقاله آن است که ثلث مازاد بر دیه ماهیت «تعزیری» دارد. در سامان یافتن تحقیق حاضر از تحلیل نصوص و روش اجتهادی به ویژه تنقیح مناط و الغای خصوصیت استفاده شده است. اثبات این فرضیه آثار متعددی را در پی دارد که مهم‌ترین آن‌ها استحقاق دولت اسلامی بر دریافت ثلث مازاد بر دیه نفس به عنوان یکی از منابع مالی حکومت است. تغییر مواد مرتبط قانون مجازات اسلامی از دیگر آثار مورد انتظار این نظریه است. &nbsp
