بررسی تقدیم واجبِ دارای بدل در مرجحات باب تزاحم و مصادیق فقهی آن دوره50 شماره2 سال1397

Among the preferences brought up on tazāḥum (disturbance, conflict) is that the obligation that does not have a substitute becomes precedent over the obligation possessing substitute. Concerning the proof of this universal major, there are evidences and aspects brought up in methodology of Islamic jurisprudence and two referents have been brought up for this universal major and rule as verification to this principle. In this research, by exploring into four reasons for the aspects stated for proving the major and then study of the two referents that are brought up, it is concluded that if the obligation possesses latitudinal substitute, there would occur no tazāḥum and it stands out of question; and if the obligation possesses a longitudinal substitute, two positions are to be discussed: A. It should be said concerning the proof of major on preferences in the section of disturbance: this case is not acceptable as an independent criterion in preferences with disturbance; rather, the issue should be studied independently in every case and all the evidences and aspects that are stated for approximation of this universal criterion are discredited. B. Concerning the vacillation between impure (khubthiya) purification and ritual impurity (ḥadathiya) purification, it should be stated that: one cannot clearly use evidences that legal authority is acquired in water purification and thus one cannot make a judgment concerning this criterion for the precedence of khubthiya purification over ḥadathiya purification; rather, one should appeal to another evidence: concerning the vacillation between full performance of on-time prayer with tayammum (ablution with earth or sands) and performance of one rak‘a of on-time prayer with wuḍū (ablution with water), performing tayammum would be precedent to wuḍū only because full performance of on-time prayer is more important.از مرجحات مطرح شده در باب تزاحم این است که واجبی که دارای بدل نیست بر واجب دارای بدل مقدم می‌گردد. در مورد اثبات این کبرای کلی دلایل و وجوهی در علم اصول مطرح شده است و برای این کبرا و ضابطه کلی، دو مصداق به عنوان تطبیق بر این قاعده بیان شده است. در این جستار با واکاوی چهار دلیل از وجوهی که برای اثبات کبرا بیان شده و سپس بررسی دو مصداقی که مطرح گردیده است، به این نتیجه رسیده‌ایم که اگر واجب، دارای بدل عرضی باشد، اصلاً تزاحمی پدید نخواهد آمد و موضوعاً از محل بحث خارج است و اگر واجب، دارای بدل طولی باشد، در دو مقام باید بحث شود: الف) در مورد اثبات کبرا در باب مرجحات باب تزاحم باید گفت: این مورد به عنوان ضابطه‌ای مستقل در مرحجات با تزاحم قابل قبول نیست بلکه باید در هر موردی مسأله به صورت مستقل مورد بررسی قرار گیرد و تمام ادله و وجوهی که برای تقریب این ضابطه کلی بیان شده‌اند، دچار خدشه هستند. ب) در مورد دوران امر بین طهارت خبثیه و طهارت حدثیه باید گفت: نمی‌توان به روشنی از ادله استفاده نمود که در طهارت مائیه، قدرت شرعی اخذ گردیده است و لذا نمی‌توان از باب این ضابطه بر تقدم طهارت خبثیه بر طهارت حدثیه حکم نمود بلکه باید به دلیل دیگری تمسک نمود؛ در مورد دوران امر بین درک تمام نماز با تیمم در وقت و ادراک یک رکعت از نماز با وضو در وقت هم تنها به دلیل آن‌که درک کردن تمام نماز در وقت اهم است، تیمم کردن بر وضو گرفتن مقدم خواهد بود
