Shell Nigeria responsibility for damages arising in connection with oil extraction in the Niger Delta

Praca skupia się na problematyce odpowiedzialność Shell Nigeria za szkody powstałe w związku z wydobyciem ropy naftowej w Delcie Nigru. Celem pracy jest przedstawienie działalność wydobywcza Shell w Nigerii, która ma negatywne skutki zarówno dla środowiska naturalnego jak i lokalnej społeczności, a także efektywności egzekwowania odpowiedzialności przez podmioty krajowe, jak i środowisko międzynarodowe. Niniejsza praca porusza także temat oskarżeń Shell Nigeria o łamanie praw człowieka. W pierwszej kolejności zostały omówione luki prawne, które pozwalają przedsiębiorstwu na uniknięcie naprawy szkód i wypłaty odszkodowań. Następnie zostały przedstawione przykłady katastrof ekologicznych związanych z działalnością wydobywczą koncernu oraz zaniechania jakich się dopuścili, a także związane z tymi wydarzeniami procesy sądowe. Kolejny rozdział poświęcony jest analizie oskarżeń Shell Nigeria o korupcje i łamanie praw człowieka. Ostatni rozdział poświęcony jest także raportowi UNEP, dotyczącego oceny stanu środowiska naturalnego oraz procesu naprawczego. Hipotezy postawione w pracy wskazują, że Shell Nigeria poprzez swoją działalność w Nigerii doprowadziło do zniszczenia środowiska naturalnego delty Nigru oraz przyczyniło się do destabilizacji regionu i łamania praw człowieka.The work focuses on the issue of Shell Nigeria's liability for damages caused in connection with oil extraction in the Niger Delta. The aim of the work is to present Shell mining operations in Nigeria, which have a negative impact on both the environment and the local community. The academic paper also analyses the effectiveness of enforcement of responsibility by national entities and the international community. This work also considers Shell Nigeria allegations of human rights violations. It first looks at the legal gaps that allow the company to avoid repairing damages and paying compensation. It is followed by examples of environmental disasters and omissions in the company mining operations, as well as related legal proceedings. The next chapter is focused on analysing Shell Nigeria allegations of corruption and human rights violations. The last chapter is also devoted to the UNEP report on environmental damage assessment and recovery. The hypotheses in the paper point out how Shell Nigeria activities in Nigeria have led to the destruction of the Niger Delta environment and contributed to the destabilisation of the region and human rights abuses
