Formulasi Pengaturan Tahapan Pra Kontrak dalam Proses Pembentukan Kontrak di Indonesia

This paper aims to encourage the immediate regulation of pre-contract stage in Indonesian laws as well as to provide an overview of the pre-contract stage regulations in several countries. In general, formation of contract processis divided into three stages, the first is the pre-contract stage, the second stage is the enforcement of the clauses of the contract and the third is the post-contract stage.In Indonesia, the regulation of contract was regulated in the Book III of the Burgerlijk Wet Boek which only regulates the legal protection after the contract has been agreed.That means legal protection for the parties in the pre-contract stage is not yetregulated by the Indonesian laws. The lack of legal protection often harmsthe parties who are still inthe pre-contract stages, therefore fairness and good faith in contract formation was not achieved
