Argentina, Uruguay and Mercosur: institutions, regulations and heritage policies in the context of a customs union.

The current study aimed to investigate the field of Cultural Heritage in regard to patrimonial institutions of Argentina and Uruguay and official offices of MERCOSUL. This research main objective was to appreciate specific characteristics of this field, considering national realities and the specific institutions of this custom union. MERCOSUL has as its main goals the integration between markets, politics and economy of its States Parties. Such configuration interferes with the understanding of the role and importance of the patrimonial field in MERCOSUL. This study observed that this field is trespassed by the structure of National States and, simultaneously, by specific institutions of this custom union that fostered cultural heritage policies that aimed to promote the integration of the National States parties. These policies occurred from joint actions or from the convergence of pre-existing policies, although there remain asymmetries among these countries regarding the scope of their norms and patrimonial institutions and predominate policies of national character. In this sense, this manuscript investigated how this field is configured, considering the specificities of national legislation, policies and MERCOSUR institutions that deal with heritage issues. Although incipient, MERCOSUR has contributed to the policies of patrimonial preservation of the States Parties, even though many possibilities could be better explored. From this perspective, the study begun with the analysis of MERCOSUR reality, focusing on the norms and heritage institutions of Argentina and Uruguay and advanced with case studies of cultural goods existing in the custom union context.Sem bolsaO presente estudo investigou o campo do Patrimônio Cultural com foco em instituições patrimoniais da Argentina, do Uruguai e órgãos do MERCOSUL. Buscou compreender características desse campo, considerando realidades nacionais e as instituições específicas da união aduaneira. O MERCOSUL tem como objetivos principais a integração entre mercados, política e a economia de seus Estados Partes. Tal configuração interfere na compreensão sobre como e qual é a dimensão e a importância desse campo patrimonial. O trabalho observou que tal campo está constituído a partir dos Estados Nacionais, ao mesmo tempo em que órgãos da união aduaneira começam a potencializar políticas patrimoniais que promovem a integração entre os seus Estados Partes. Essas políticas ocorrem a partir de ações conjuntas ou com a convergência de políticas já existentes, embora permaneçam assimetrias entre esses países quanto ao alcance de suas normas e instituições patrimoniais e predominem as políticas de caráter nacional. Nesse sentido, o trabalho investigou como está configurado esse campo, considerando as especificidades das legislações, políticas e instituições patrimoniais nacionais e dos órgãos do MERCOSUL, que trabalham com temas do patrimônio. Ainda que timidamente, o MERCOSUL tem contribuído com as políticas preservacionistas dos Estados Partes, mesmo que muitas possibilidades do campo devam ser melhor exploradas. Nessa perspectiva, o trabalho primeiramente busca compreender a realidade do MERCOSUL, para na sequência analisar as normas e instituições patrimoniais de Argentina e Uruguai, chegando ao fim com estudos de caso de bens culturais existentes no contexto do bloco
