Le Contrat Territorial d'Exploitation : la rencontre difficile d'un instrument à vocation territoriale et de la tradition sectorielle de la politique agricole française

It was presented as a territorial policy instrument, at the service of sustainable development that set out to encourage the multifunctionality of agriculture. However, the mid-term evaluation of the programme revealed that its conditions of implementation did not make it possible to fully achieve these ambitions. While it may have helped to make the principle of the contractualization of subsidies more generally accepted and legitimized the notion of the environment as a criterion in the definition of agricultural policies, more often than not, the definition frameworks of these contracts were restricted to the agricultural sphere alone and their target public to the relatively limited fringe group of farmers who were already familiar with the workings of the departmental institutions in charge of agricultural development. This paper sets out to not only describe some of the limitations of this programme but also its positive repercussions. Both are important factors if we want to approach national and European agricultural policy in terms of territorialization and with due consideration for rural development issues. The LMC was the main instrument of the Agriculture Framework Law of 1999 that embodied a 'new approach to the management of public action' via a policy that 'takes into account the economic, environmental and social functions of agriculture and participates in land management with a view to sustainable development', as stipulated by the first article of the Agriculture Framework Law of 9 July 1999.De 1999 à 2002, le programme CTE a constitué le principal mode d'application française du règlement de développement rural européen. Il était présenté comme l'instrument d'une territorialisation de l'action publique, au service d'un développement durable passant par la promotion de la multifonctionnalité de l'agriculture. L'évaluation réalisée à mi-parcours montre toutefois que ses conditions de mise en ½uvre n'ont pas permis de réaliser pleinement ces ambitions. Il a permis la généralisation du principe de contractualisation des aides et conduit à introduire l'environnement comme un critère légitime de définition des pratiques agricoles. Néanmoins, les cadres de définition de ces contrats sont, très souvent, demeurés réduits à la seule sphère agricole et leur public à la frange relativement limitée des agriculteurs inscrits dans le jeu habituel des institutions départementales du développement agricole. Cette contribution décrit certaines des limites de ce programme autant que les avancées qu'il a permises. Les unes comme les autres constituent des éléments importants pour penser la politique agricole nationale et européenne en terme de territorialisation de l'action publique et de prise en compte des questions de développement rural. Le contrat territorial d'exploitation (CTE) constituait le principal instrument au service du projet de la Loi d'Orientation Agricole de 1999, concrétisant une « nouvelle approche de la gestion de l'intervention publique » dans une politique qui « prend en compte les fonctions économiques, environnementales et sociale de l'agriculture et participe à l'aménagement du territoire, en vue d'un développement durable » ainsi que le stipule l'article premier de la Loi d'Orientation Agricole du 9 juillet 1999
