Re pensando el futuro de la institución familiar

The summer of 2008 was full of tension between advocates and opponents of a bill that, if approved, would make it easier for couples with no children or common heritage to be separated and then divorce by mutual agreement or consensus. With the first approval of the draft of this bill (notarial or municipal divorce bill) was presented in april, another opportunity to reflect on the family as an institution, which happens to be in the center of various laws, even though not always the authors and sponsors of those laws are diligent in presenting the starring institution of society, the "family". Since the bill (commonly referred to as “express divorce law”) had to amend the Organic Law of Municipalities, it was logical to consider and expect that the whole Congress should approve the amendment twice, if it was to succed. However, that was not the case. In mid-May, the legal community received, with some surprise, the official text of the Act Nº 29227, which gave the power to Notaries and City Hall officials to receive requests of separation for further divorce in the aforementioned situations. The substance of the proposal seeks to accelerate the proceedings, with its proponent claiming that there are three million files without a decision. However, Judicial Branch officials have clarified that there are only 32,000 cases on divorce and, if the specifics are analyzed, only thirteen thousand cases of divorce based on consensus are pending final judgment. It has to be noted that those who supported the bill widely exaggerated the numbers to impress the lay public law. Basically, what the authors of the proposition wanted was to make it easier for people to get a divorce, making it more accessible to those who have problems or concerns in their married life.El verano de 2008 fue de muchas tensiones entre los defensores y detractores de un Proyecto que “facilitará” el divorcio de quienes no tienen hijos ni patrimonio común y desean separarse, para después divorciarse de acuerdo o en consenso. Con la primera aprobación del Proyecto de Divorcio que estaría a cargo de los Notarios Y Municipios, se presentaba en el mes de abril pasado, otra ocasión de reflexionar sobre la institución familiar, protagonista de diversas leyes, aún cuando no siempre los autores y coautores, se esmeren en presentar debidamente a la institución protagonista de la sociedad, la “familia”. Como quiera que se trataba de modificar la Ley Orgánica de Municipalidades, era lógico considerar y esperar que el pleno del Congreso debería aprobar dos veces dicha enmienda, si prosperara. Sin embargo no fue así, a mediados de mayo la comunidad jurídica recibió, algunos con sorpresa, el texto oficial de la Ley Nº29227 dando competencia a los Notarios y a las Municipalidades, para recibir demandas de separación con ulterior divorcio, en las situaciones referidas. El fondo de la propuesta es buscar la celeridad procesal, alegando que hay tres millones de expedientes sin sentencia. Los jueves han aclarado que se trata solo de 32,000 expedientes sobre divorcio y si se estudia la especialidad, solo 13 mil casos basados en el consenso se encuentran pendientes de fallo final. Nótese que siempre quienes hacen la propaganda exageran ampliamente los números para impresionar al público lego en derecho. En el fondo lo que se proponen los autores del proyecto es “Facilitar” los divorcios, hacerlos más accesibles a quienes tienen problemas o preocupaciones en su vida matrimonial
