Gestão jurídico-estratégica do cibercrime no contexto da ciberdemocracia

Inside the context of a globalized and technological modern society, new possibilities for communication and access to knowledge rises autonomously, through connections and shared knowledge, constructing identity, especially in the political and cultural fields characterizing the cyber democracy. However, the interconnection of computers and systems, combined with computer dependency of numerous sectors, will let the netizens exposed and vulnerable to cyber attacks, enabling the emergence of so-called Cybercrime. The research has as main objective to investigate the forms of legal and strategic Cybercrime management in the context of cyber democracy from the analysis of the phenomenon. The vast social-cultural transformation, political, technological and legal problems arise from intensive mass use of the Internet, emerging thus illicit practices in the virtual scene. It is a survey of methodological procedure under a bibliographical analysis of exploratory and descriptive form. In this orbit, the study is anchored in references dealing, critically, with the institutes of cyber democracy (as a new form of human action, interconnection and the construction of knowledge, culminating in the street movements) and Cybercrime (their types, forms of implementation, the faces of anonymity, legislation and investigative process). It concludes that to achieve success in the investigative process and punishment of violators of Cybercrime is necessary to create legal provisions with less burocratic processes, the taking of evidence, the acquisition and preservation of data, since the speed in the investigation of such crimes is crucial to solve them. Given the above, we note that the technologies and principles of the information society, the Internet democracy and cyber crimes are effervescent and complex issues, both for the state administration, as to the legal harvest, because they are still being redesigned and studied. Therefore, it appears from the analysis that the guidelines of a legal management effective strategy permeate the creation of an integrated task force of police, prosecutors and judges, as well as a significant government investment to prevent and cyber defense, and the signing of international cooperation agreements to combat cyber crimes. The matter is adressed to be of far-reaching in social jurisdiction, and how it can influence in the future, the scholars, legislators and national and international organizations, in order to seek specific and decisive manner. The best way to do a strategic management in preventing and combating cyber crime is safeguarding the new ideas of democracy cultivated in cyberspace. Thus, ongoing research presents a useful nature, contributing to the pursuit of network security, the guarantee of fundamental rights and the ethical and legal balance in the digital age.NenhumaNo contexto da sociedade contemporânea globalizada e tecnológica, novas possibilidades de comunicação e acesso ao conhecimento surgem de forma autônoma, por meio das conexões e saberes compartilhados, construindo identidades, especialmente nos campos político e cultural caracterizando a denominada Ciberdemocracia. No entanto, a interconexão de computadores e sistemas, aliada à dependência informática de inúmeros setores, deixa internautas expostos e vulneráveis a ataques virtuais, possibilitando o surgimento dos chamados Cibercrimes. A pesquisa tem como objetivo precípuo investigar as formas de Gestão Jurídico-estratégica do Cibercrime no contexto da Ciberdemocracia, a partir da análise do fenômeno da mundialização, da vasta transformação sociocultural, política e tecnológica e dos problemas jurídicos advindos da massificação intensa do uso da Internet, surgindo, assim, as práticas ilícitas no cenário virtual. Trata-se de uma pesquisa com procedimento metodológico sob uma análise bibliográfica de caráter exploratório e descritivo. Nessa órbita, o estudo ancora-se em referências que tratam, de modo crítico, dos institutos da Ciberdemocracia (como nova forma do agir humano, das interconexões e da construção de saberes, culminando com os movimentos de rua) e dos Cibercrimes (suas tipologias, formas de execução, as faces do anonimato, legislação e processo investigatório).Conclui-se que para alcançar êxito no processo investigativo e na punição dos infratores dos Cibercrimes é preciso criar dispositivos legais que desburocratizem o processo, a obtenção das provas, a aquisição e preservação dos dados, já que, a celeridade na investigação de tais crimes é fundamental para descobrir sua autoria. Diante do exposto, nota-se que as tecnologias e os princípios da sociedade de informação, a democracia da Internet e os crimes cibernéticos são assuntos efervescentes e complexos, tanto para a administração estatal, quanto para a seara jurídica, pois ainda estão sendo redesenhados e estudados. Portanto, depreende-se da análise que as diretrizes de uma gestão jurídico-estratégica eficaz perpassam pela criação de uma força tarefa integrada entre policiais, membros do Ministério Público e magistrados, além de um investimento significativo do governo para a prevenção e defesa cibernéticas, bem como a assinatura de acordos de cooperação internacional no combate à ciberdelinquência. A matéria abordada, por ser de profundo alcance sociojurídico, pode influenciar num futuro, pouco distante, os doutrinadores, legisladores e organismos nacionais e internacionais, para que se busque de maneira específica e decisiva a melhor forma de gestão estratégica na prevenção e combate aos Cibercrimes, mas salvaguardando o ideário novo de democracia cultivado no ciberespaço. Dessa forma, a investigação em curso apresenta uma natureza profícua, podendo contribuir para a busca da segurança na rede, da garantia dos direitos fundamentais e do equilíbrio ético e jurídico na era digital
