TANGGUNG JAWAB NOTARIS PENGGANTI TERKAIT PEMBUATAN AKTA NOTARIS YANG MERUGIKAN PARA PIHAK AKIBAT KELALAIANYA

Abstract Notary was a public officer with the authority over authentic documents and other discretions. This position was supported by Section 1 Number (1) of Law No.2/2014 about Amendment to Law No.30/2004 about Notary Rank. Research methods used by the author is a normative legal research methods. The purpose of this research is to analyze about the responsibilities of a substitute Notary and legal remedies against the deed made by him. Theory is a theory that the author used the authority, responsibility theory and the theory of justice. If every section about the Substitute Notary must be explained and analyzed, including Section 33, then it could be said, that the Substitute Notary might have degree of authority that was similar to that of the Notary in relative to the administration of authentic documents. In Section 65, the Substitute Notary could also have the responsibility that was similar to that of the Notary for the administration of authentic documents. However, it should be better to have the specific regulation about the authority and responsibility for the Substitute Notary. Additional requirements and authority limitation might be relevant for the Substitute Notary. Key words: Authority, Responsibility, Notary, Substitute Notary  Abstrak Notaris ialah pejabat umum yang memiliki wewenang untuk membuat akta otentik dan kewenangan lainnya sebagaimana dimaksud dalam pasal 1 angka (1) Undang-Undang Republik Indonesia Nomor 2 Tahun 2014 Tentang Perubahan atas Undang-Undang Nomor 30 Tahun 2004 Tentang Jabatan Notaris. Metode penelitian yang digunakan penulis ialah metode penelitian hukum normatif. Tujuan penelitian ini untuk menganalisis tentang tanggung jawab Notaris pengganti dan solusi hukum terhadap akta yang dibuat olehnya. Teori yang dipakai penulis adalah teori kewenangan, teori tanggung jawab dan teori keadilan. Jika melihat penjelasan dan menganalisis dari pasal perpasal mengenai Notaris pengganti, Pasal yang menjelaskanya antara lain pasal 33, mengenai hal ini Notaris, Notaris pengganti memiliki kewenangan yang sama terkait pembuatan akta otentik yang dibuat olehnya. Disisi lain dalam pasal 65, Notaris, Notaris pengganti memiliki tanggung jawab yang sama dalam pembuatan akta otentik dengan Notaris. Sebaiknya harus ada aturan tersendiri mengenai kewenangan dan tanggung jawab Notaris pengganti. Harus ada penambahan syarat dan pembatasan kewenangan terhadap Notaris pengganti.  Kata kunci :Kewenangan, TanggungJawab, Notaris, Notaris Penggant
