Le droit international et la lutte contre la pollution marine par les déchets de matières plastiques

International audiencePlastic waste is accumulating and invading the oceans, so that some predictions suggest that the oceans could be home to more plastic waste than fish in the next 30 years or so. In this context, the international instruments traditionally mobilized to combat marine pollution caused by this phenomenon are proving insufficient, both in their implementation and in their content. In order to understand the complexity and global nature of marine pollution by plastic waste, an approach that takes into account all stages of the life cycle of plastics, as well as the accidental and intentional transboundary movements they undergo, is now necessary. Although the international community is progressively integrating this need through existing international instruments and regimes, while considering the possibility and opportunity to adopt a new treaty on the subject, the fight against plastic pollution of the oceans remains a real challenge for international law.Les déchets de matières plastiques s’accumulent et envahissent les océans, si bien que d’après certaines prévisions, ces derniers pourraient abriter, d’ici une trentaine d’années, plus de déchets plastiques que de poissons. Dans ce contexte, les instruments internationaux traditionnellement mobilisés pour lutter contre la pollution marine engendrée par ce phénomène s’avèrent insuffisants, tant dans leur mise en œuvre que dans leur contenu. Pour appréhender la complexité et la globalité de la pollution marine par les déchets de matières plastiques, une approche prenant en compte l’ensemble des étapes du cycle de vie du plastique, ainsi que les mouvements transfrontières à la fois fortuits et intentionnels qu’ils subissent, est aujourd’hui nécessaire. Bien que la communauté internationale intègre progressivement cette nécessité au travers des divers régimes et instruments internationaux existants, tout en envisageant la possibilité et l’opportunité d’adopter un nouveau traité en la matière, la lutte contre la pollution plastique des océans demeure un véritable défi pour le droit international
