La justicialidad de los derechos humanos

This paper focuses its analysis in three issues: the future, human rights and its justiciability. In the first place, in connection with the future, all of us must decide constantly, but our decisions and the ones from judges are almost decided (by moral, religion, political ideas, ideologies, theories and affections). In the second place, human rights are attributed and recognised as people ́s rights, and prevent political ocuppation of the society. When social order becomes critical for the State and for politics, human rights act on high sensible issues. In the third place, the majority of individuals live excluded, and therefore people ́s individuality private body stays there. It is expected that once in modern society history; human rights can contribute to treat bodies as persons.El artículo se centra en el análisis de tres temas: el futuro, los derechos humanos y su justiciabilidad. En primer lugar respecto del futuro todos debemos decidir, pero sin embargo nuestras decisiones al igual que las de los juristas están ya decididas (por la moral, religión, ideas políticas, ideologías, teorías, pasiones y afectos). En segundo lugar, los derechos humanos son atribuidos o reconocidos como derechos de las personas, e impiden la ocupación política de la sociedad. Cuando el orden social se vuelve crítico para el Estado y para la política, en los puntos de alta sensibilidad operan los derechos humanos. En tercer lugar, la mayor parte de los individuos vive en la exclusión, y allí queda el cuerpo privado de la individualidad de la persona. Se espera que una vez más en la historia de la sociedad moderna, los derechos humanos puedan contribuir a tratar a los cuerpos como personas
