Consideraciones sobre el artículo 155 de la Constitución Española como instrumento de coerción estatal

After the application of article 155 of the Spanish Constitution by the central government as a reaction against the Catalan souveranist challenge in 2017, doubts and questions about this constitutional provision have clearly arisen. Furthermore, recourse to this instrument of state coercion has unleashed both praise and criticism in Spanish society, and repeated appels to the use of this extraordinary mechanism by some political parties have been frequent. In that sense, the recent pronouncements of the Spanish Constitutional Court related to the actions of unconstitutionality brought against the activation of article 155 of the Spanish Constitution by Rajoy’s Executive have supported the measures taken by the Spanish government and have established case law doctrine in this field. On the basis of the above, this paper pretends to offer an original approach to article 155 of the Spanish Constitution in order to contribute to the legal-constitutional debate around it and to look into several aspects that might have not been taken into account so far. Thus, the following pages focus in detail on the nature and the content of the aforementioned precept, on the keys of the drafting process of this article at the Constituent Cortes. Subsequently, an overview of similar mechanisms contemplated in other constitutions is given to conclude with a brief analysis of the sentences recently handed down by the Constitutional Court, endorsing the application of Article 155 of the Spanish Constitution in Catalonia.Tras la aplicación del artículo 155 de la Constitución Española (CE) por parte del Gobierno central ante la deriva soberanista en Cataluña en 2017, las dudas y especulaciones sobre dicha disposición constitucional se han disparado. El recurso a esta herramienta de coerción estatal también ha desatado tanto elogios como críticas en la sociedad española, y las apelaciones reiteradas al uso de este mecanismo extraordinario por parte de algunos partidos ha sido una constante. En ese sentido, los recientes pronunciamientos del Tribunal Constitucional ante los recursos de inconstitucionalidad planteados contra la activación del art. 155 CE por el Ejecutivo de Rajoy han avalado la actuación del Gobierno central y han establecido doctrina jurisprudencial en esta materia. A partir de lo expuesto, en el presente trabajo se realiza una aproximación original al artículo 155 CE con la que se trata de contribuir al debate jurídico-constitucional y profundizar en algunos aspectos algo desconocidos hasta ahora del mismo. Así pues, en las siguientes páginas se aborda tanto la naturaleza como el contenido del mencionado precepto de forma pormenorizada, se introducen las claves sobre el proceso de redacción del mismo en las Cortes Constituyentes. A continuación, se repasan varios mecanismos similares previstos en otras constituciones para finalizar con un breve análisis de las sentencias dictadas recientemente por el Tribunal Constitucional en las que avala la aplicación del art. 155 CE en Cataluña
