Direito à saúde: abordagem sistêmica, risco e democracia

This article intends to demonstrate that the health is a system and that your juridical protection will only be satisfactory if done based in the pragmatic systemic idea of right, by Niklas Luhmann, besides to show that the decisions about it contains an intrinsic risk resultant of the differentiation and of the communication between the system-health and the other social systems, as well as to prove that the risk should be considered requirement so that the right to the health is also a space of democratic (re)invenction (LEFORT, 1991).Este artigo pretende demonstrar que a saúde é um sistema e que sua proteção jurídica somente será satisfatória se feita com base na matriz pragmático-sistêmica de direito, de Niklas Luhmann, além de demonstrar que as decisões a seu respeito contém um risco intrínseco resultante da diferenciação e da comunicação entre o sistema-saúde e os demais sistemas sociais, bem como provar que o risco deve ser considerado requisito para que o direito à saúde seja também um espaço de (re)invenção democrática (LEFORT, 1991)
