Relevancia y sentido del buen trato a las fuentes del Derecho en la escritura jurídica

Law is found, in great measure, in written sources of knowledge. The right treatment given to legal material is one of the main problems of academics and law professionals. This difficulty is due to diverse causes: sources are incalculable and have different nature; jurists lack, in many cases, proper research and writing skills; our science does not have a unified system of citation, among others. This article intends to give some guidelines in order to overcome said deficiencies, offering recommendations and suggestions on the proper way of treating and citing the sources which the jurist uses in his work. It also aims to render directives oriented to create an adequate art of writing cares over substantive part of the work as well as the formal.DOI: 10.5294/dika.2010.19.2.10El Derecho se encuentra, en buena medida, en fuentes escritas de conocimiento. El correcto tratamiento del material jurídico es uno de los principales problemas de los académicos y profesionales del Derecho. Esta dificultad proviene de diversas causas: las fuentes son incalculables y de diversa naturaleza; los juristas carecen, en muchos casos, de un adecuado oficio de investigación y de escritura; nuestra ciencia carece de un sistema unificado de citación, entre otras. Este artículo pretende brindar algunas directrices en orden a subsanar esas deficiencias, ofreciendo algunas recomendaciones y sugerencias sobre la forma adecuada de tratar y de citar las fuentes con las que trabaja el jurista, así como directivas orientadas a crear un adecuado arte de escritura, que cuide tanto del fondo como de la forma.
