Tworzenie samorządowych instytucji kultury

The subject of this paper is the analysis and critical recognition of public law regulations concerning the creation of cultural institutions by local self-government units. In the paper, in addition to guidance that may be useful both to law practitioners as well as specialists in administrative law, the position of doctrinal representatives and practice in issues related to the mere execution of the law by the organs of local self-government units is also confronted. The paper highlights the most important issues related to the establishment of a self-governing cultural institution, among which can be mentioned: the issue of the act on the establishment of a cultural institution, its statute and registration.Przedmiotem niniejszego opracowania jest analiza oraz krytyczne ujęcie regulacji publicznoprawnych dotyczących tworzenia instytucji kultury przez jednostki samorządu terytorialnego. W pracy, oprócz wskazówek, które mogą być przydatne zarówno praktykom prawa, jak i administratywistom, konfrontowane jest stanowisko przedstawicieli doktryny oraz praktyki w kwestiach związanych z samym procesem wykonywania prawa przez organy jednostek samorządu terytorialnego. Ponadto wskazano na najważniejsze kwestie, jakie są związane z utworzeniem samorządowej instytucji kultury, pośród których można wymienić: wydanie aktu o utworzeniu instytucji kultury, nadanie jej statutu i wpisanie do rejestru
