“This is a decision that the Court and the Nation will come to regret.” Justice Stephen G. Breyer The Supreme Court decision in PICS v. Seattle came as little surprise to the many who believed that the current conservative makeup of the court would triumph over legal reasoning and precedent. The decision was 5-4 against the school districts, but the difference was 4-1-4 with liberal and conservative justices splitting evenly, and moderate conservative, Justice Anthony Kennedy, concurring with the decision of the other conservatives, but not their entire reasoning. This split reminds us that the issue of race is far from being fully resolved in the nation’s highest court
