PENERAPAN PERATURAN MAHKAMAH AGUNG NOMOR 2 TAHUN 2012 TENTANG PENYESUAIAN BATASAN TINDAK PIDANA RINGAN DAN JUMLAH DENDA DALAM KUHP BERKAITAN DENGAN ASAS KEADILAN (Studi Kasus Tindak Pidana Pencurian di Wilayah Hukum Pengadilan Negeri Lubuk Basung)

The crime of theft especially theft with is the value losses is not more than Rp.2.500.000,- (two million and five hundred thousand rupiah) often happen both of upper middle society and under middle society, both in urban and rural. Theft with is the value losses is not more than Rp.2.500.000,- (two million and five hundred thousand rupiah) are categorize as crime of minor theft as regulated by Rule of Supreme Court Number 2 in 2012 about Adjustment of Limitation of Misdemeanor and Total Fine on the Criminal Code. Rule of Supreme Court Number 2 in 2012 change Adjustment of Limitation of Misdemeanor and Total Fine on the Criminal Code in the misdemeanor cases as state in Article 364, 373, 379, 384, 407, and 482 of the Criminal Code with is originally minimum limitate Rp.250,- (two hundred and fifty rupiah) to Rp.2.500.000,- (two million and five hundred thousand rupiah) and the amount of criminal fine is multiplied to 1000 times except for Articles 303 Paragraph (1) and (2) and Articles 303 bis Paragraph (1) and (2) of the Criminal Code. The presence of Rule of Supreme Court Number 2 in 2012 is response from the Indonesia’s Highest Court about injustice that feel by society with is appear cases such as Nenek Minah, theft of sandals, etc. On this thesis, the author use sociological research methods or juridical sociological (socio legal approach). In this thesis discuss about 2 problems are “How are The Implementation Rule of Supreme Court Number 2 in 2012 about Adjustment of Limitation of Misdemeanor and Total Fine on the Criminal Code on Crime Theft by Judges in jurisdiction of District Court Of Lubuk Basung Related with the Principles of Justice” and “What are constraints on the Implementation Rule of Supreme Court Number 2 in 2012 about Adjustment of Limitation of Misdemeanor and Total Fine on the Criminal Code on Crime of Theft by Judges in jurisdiction of District Court of Lubuk Basung. Rule of Supreme Court Number 2 in 2012 has not been consistently applied by Judges of District Court of Lubuk Basung and other law enforcement officers like Investigators of Police Resort of Agam and Prosecutors of District Attorney of Lubuk Basung are not guide by the Rule of Supreme Court Number 2 in 2012 in processing crime of theft. As for the constraints that appear from implementation Rule of Supreme Court Number 2 in 2012 which are in the process of cases such detention process, administration of cases, the evidence process, verdicts, and the effectiveness of fine.
