Política judiciária brasileira: da produção de cidadania à cooptação sistêmica

Th is paper analyzes the eff orts of Justice in the Brazilian State Journal and its clear intention to co-opt alternative designs of Justice. It addresses the theories and practices of Community Justice in its original aspect, participatory and emancipatory unoffi cial, and also to Restorative Justice, by comparison to recent attempts in the regular courts include such projects and make them public-state from its bias proceduralism predetermined (ritualistic). It aims to refl ect on the possibility of success of these attempts before systemic irritation generated by alternative practices that arise in modern society. He speaks of the practices of restorative justice that has advanced throughout the world in theoretical terms (and practical) on the inability of Criminal Justice to account for the complexities that involve more intense confl ict, and also the theory and practice of Justice Community that has spread from the unveiling of the existence and multiplicity of cultural in- fl uences and their inherent needs, of which the state and its juridical paradigm, can not aff ord to cover, regular, and perhaps emancipate. We work from a literature review and a highly referential bias of legal pluralism and refl ective critique. Understanding how a study that holds signifi cance given the momentum of the system encompass the dynamic alternatives, and thus intends to disclose such practices.Neste trabalho se analisa os esforços da Justiça Oficial e Estatal brasileira na sua clara intencionalidade de cooptar projetos alternativos de Justiça. Abordam-se as teorias em práticas da Justiça Comunitária em sua vertente originária, participativa, extraoficial e emancipatória, assim como, também a Justiça Restaurativa, em cotejo com as recentes tentativas da Justiça ordinária em englobar tais projetos e torná-los público-estatais, a partir de seu viés de procedimentalidade pré-determinada (ritualizada). Objetiva-se refletir sobre a possibilidade de sucesso destes intentos sistêmicos diante da irritação gerada por práticas alternativas que surgem no seio da sociedade moderna. Fala-se das práticas de Justiça Restaurativa que tem avançado no mundo todo em termos teóricos (e práticos) diante da incapacidade da Justiça Criminal em dar conta das complexidades que envolvem os conflitos cada vez mais intensos; e, também da teoria e praticas de Justiça Comunitária que se tem difundido a partir da existência e desvelamento da multiplicidade de aportes culturais e suas necessidades imanentes, das quais o Estado e seu paradigma de juridicidade, não têm condições de abarcar, regular e, quiçá, emancipar. Trabalha-se a partir de uma análise eminentemente bibliográfica e de um referencial de pluralismo jurídico de viés critico e reflexivo. Entendendo como um estudo que guarda importância dado o ímpeto do sistema em abarcar as dinâmicas alternativas, e assim, propõe-se a desvelar tais práticas
