This article addresses the predominant role that the Colombian Constitutional Court has acquired in the regulation, monitoring and control of the healthcare system in Colombia, with emphasis on the approach that the Court has taken towards those matters that fall under the competence of the independent regulatory agency for the healthcare system, the Health Regulatory Commission (CRES). The importance of courts as key actors in the national regulatory environments has already been highlighted in previous studies, which have suggested that this may be a distinctive feature of the Regulatory State of the Global South
