Abstract: Thinking tradition of Islamic law understands that society varies in attributes, characters and environment. Such diversity is apparent in certain individual behaviors which sometimes are not accepted as legal acts in modern society, but merely customs and social behaviors. Underlying considerations behind this legal thought were seriously discussed during the Umayyad dynasty. This article tries to further learn the epistemological framework of thinking during Umayyad dynasty.
