The right of communication to the public in the light of the CJEU Stichting Brein v. Ziggo judgment

Jednym z podstawowych uprawnień przysługujących twórcom jest sformułowane w art. 3 ust. 1 dyrektywy 2001/29 prawo do publicznego udostępniania utworów. Z uwagi na brak jego stosownej definicji Trybunał Sprawiedliwości Unii Europejskiej wielokrotnie już stawał przed koniecznością określenia przesłanek tego pojęcia. Orzeczeniem w sprawie Stichting Brein przeciwko Ziggo, C-610/15, rozwija on swoje wcześniejsze rozstrzygnięcia, tym razem w odniesieniu do działań operatorów witryn internetowych. W wyroku tym uznano, że platforma wymiany online The Pirate Bay narusza prawo autorskie do publicznego udostępniania utworów - stwierdzono równocześnie, że dla przyjęcia odpowiedzialności tego rodzaju dostawców usług internetowych nie jest wymagana ich faktyczna wiedza na temat bezprawnego charakteru zamieszczanych przez użytkowników treści. Przedmiotowe orzeczenie skłania do refleksji nad konstrukcjami bezpośredniego i pośredniego naruszenia prawa autorskiego, a także stosunku ustaleń Trybunału do ograniczeń i wyłączeń odpowiedzialności usługodawców zawartych w dyrektywie 2000/31. Artykuł ten ma na celu krytyczną analizę powyższych wątpliwości, przy jednoczesnym zgłoszeniu postulatów co do kierunku dyskutowanej obecnie w Unii Europejskiej reformy prawa autorskiego.One of the basic rights of authors is the right of communication to the public, laid down in art. 3(1) of Directive 2001/29. In the absence of a relevant definition, the Court of Justice of the European Union has repeatedly challenged the necessity of defining the terms of this concept. In its decision in Stichting Brein v. Ziggo, C-610/15, it develops its earlier conclusions, this time with regard to actions of website operators. The judgment in question found that the online sharing platform The Pirate Bay violated the right of communication to the public - what was also stated was that it is not required for these types of Internet Service Providers to possess actual knowledge of unlawful character of the content uploaded by their users to determine their liability. The decision prompts consideration of the constructs of direct and indirect copyright infringement as well as the relation of the Court's findings to the limitations and exclusions of liability of service providers within Directive 2000/31. This paper aims at critically analysing the above-mentioned doubts as well as postulating certain solutions in the light of copyright reform, which is currently being discussed in the European Union
