La disciplina del patrimonio naturale e dei beni pubblici naturali in Italia

The paper analyzes the Italian legal regime of public natural goods and natural heritage. To address this issue, the essay reconstructs firstly the legal frameworks of natural domain, starting from Civil code, of protected natural heritage (specially focused on UNESCO legislation), of protected natural areas and landscape goods. Furthermore, are highlighted the problems related to the exercise of legislative and administrative competence, sharing between national, regional and local governments, and to the management of public natural goods, specially referred to their economic development purposes. Finally, moving to the debate on common goods and planetary heritage, the article discuss about the important role of law to define a new path for use and protection of public natural goods.El presente trabajo analiza el régimen jurídico que el sistema legal italiano proporciona para los bienes públicos naturales y el patrimonio natural. En particular, el capítulo reconstruye los marcos legales de referencia del dominio natural, del patrimonio natural protegido a través de la legislación sobre sitios del patrimonio de la UNESCO, áreas naturales protegidas y bienes paisajísticos. Además, se destacan los principales problemas relacionados con el sistema de habilidades, el uso económico de estos bienes y su gestión.
