La justicia constitucional en España: los recursos ante el Tribunal Constitucional español

The defense of the Constitution as supreme law of the legal system is the main function that the different systems of constitutional justice entrust to the constitutional courts. However, these courts have a number of challenges that must be taken into account if you want to articulate a proper system of constitutional justice. We address these challenges by referring to the legal situation in Spain. In order to achieve this, we will expose the main challenges of the Spanish constitutional system of justice: the workload of the Constitutional Court, overcoming the confrontation with the Supreme Court and establishing a system of selection of judges that tends to exclude the politicization of the Court.Key words: Constitutional Court, selection of cases, selection of judges, Constitutional Justice, Spain.La defensa de la Constitución como norma suprema del ordenamiento jurídico es la principal función que los diferentes sistemas de justicia constitucional encomiendan a los tribunales constitucionales. No obstante, esos órganos tienen una serie de retos o desafíos que deben ser tenidos en cuenta si quiere articularse un correcto sistema de justicia constitucional. Esos desafíos a los que nos referimos, vamos abordarlos haciendo referencia a la situación normativa existente en España. Para ello, vamos a exponer cuáles son los principales retos del sistema de justicia constitucional español: la sobrecarga de trabajo del Tribunal Constitucional, superar el enfrentamiento con el Tribunal Supremo y prever un sistema de selección de sus magistrados quepermita excluir la politización del Tribunal.Palabras clave: tribunal constitucional, selección de asuntos, selección de magistrados, justicia constitucional, España
