Umorzenie należności oraz odroczenie terminu płatności i rozłożenie na raty płatności z tytułu składek na ubezpieczenie społeczne jako pomoc publiczna

The subject of the article is a social security contribution debt write-off, a social security contribution deferment and installment arrangement by Social Insurance Fund on a legal basis of Social security system Act as a form of individual State aid. In these cases Polish legislator used the construction of discretion administrative that makes them a potentially State aid measures. The social security debt write-off is possible when the debt is completely irrecoverable or in the particular cases related to the life situation of the debtor. Social security contribution deferment and installment arrangement may have a wider range because of less restrictive criteria for awarding them. The social security debt write-off, the social security contributions deferment and the installment arrangement may be a State aid, but they are used very rarely so they can’t be regarded as an instrument of policy of support entrepreneurs. They are addressed to the special, exceptional situations and they have more humanitarian than economic purpose.Artykuł poświęcony jest umarzaniu należności z tytułu składek na ubezpieczenia społeczne oraz odroczeniu terminu płatności i rozłożeniu na raty należności z tytułu składek na ubezpieczenia społeczne przez Zakład Ubezpieczeń Społecznych na podstawie ustawy o systemie ubezpieczeń społecznych jako formie pomocy publicznej stosowanej w sprawach indywidualnych. W obu przypadkach ustawodawca wprowadza konstrukcję uznania administracyjnego, co stanowi, że umorzenie, odroczenie terminu płatności i rozłożenie na raty należności z tytułu składek są traktowane jako potencjalnie tworzące pomoc. Możliwość umorzenia należności na podstawie ustawy o systemie ubezpieczeń społecznych istnieje w przypadku ich całkowitej nieściągalności oraz w szczególnych przypadkach, związanych głównie z trudną sytuacją życiową zobowiązanego. Szerszy zakres może mieć odroczenie terminu płatności należności i rozłożenie jej na raty, w stosunku do którego ustawodawca przyjmuje mniej restrykcyjne kryteria. Mimo tego, że analizowane umorzenia i ulgi mogą stanowić pomoc publiczną, z uwagi na niewielkie zastosowanie w praktyce trudno je traktować jako element polityki wspierania przedsiębiorców. Jest ono adresowane do wyjątkowych, szczególnych sytuacji i ma bardziej wymiar humanitarny niż gospodarczy
