Independence and selfgovernment of the judiciary.

The importance of the independence of the judiciary was highlighted both in the first edition (14 December 1993) of the Guidelines (Metmenys) of the system of the legal reform of Lithuania and in its second edition (28 June 1998). An aspiration of the legislator was perceived to have courts in democratic society as independent institutions free from the influence of the legislative and executive powers. The necessity to develop democracy in the activities of the judicial power was also emphasised in Metmenys. Does the reform of the judicial system, namely the regulative part thereof, provide the conditions for the enforcement of freedom and independence of the judiciary? What contents and meaning does the judicial independence comprise in genefal? Can it be only a legal fiction or abstraction that may be perceived and understood as conditioned by the actual situation? And finally, is it not only an attractive term to a legal doctrine and deprived of any practical application? Self-government of the judiciary in Lithuania is touched upon with great caution. The possibility of free command over the direct allocations from the State budget is the first step towards the independence of courts. On the other hand, we are absolutely convinced that the independence of the judiciary will not be comprehensive as long as the organisational activities of courts are not entrusted to the courts themselves. We will try to disclose the meaning of self-government of the judiciary and to lay basis for the statement that the independence of the judiciary- is secured by an effectively functioning and democratically formed system of their self-government and self-regulation.Teisinės sistemos reforma Lietuvoje - teisės mokslininkų ir praktinį darbą dirbančių teisininkų dėmesio centre. Referendumu priėmus Konstituciją, Lietuvos Respublikos Seimas Teisinės sistemos reformos metmenyse (toliau tekste - Metmenys) numatė kryptis, gaires, kurios, manoma, turėtų vesti link optimalaus teisinės valstybės sistemos modelio. Tiek pirmojoje (1993 m. gruodžio 14 d.), tiek antrojoje (1998 m. birželio 28 d.) Metmenų redakcijose pabrėžiama teismo nepriklausomumo svarba. Įžvelgiamas įstatymo leidėjo siekis, kad teismas demokratinėje valstybėje būtų savarankiška institucija, nepriklausoma nuo įstatymo leidžiamosios ir vykdomosios valdžių įtakos. Metmenyse pabrėžta, kad būtina plėtoti demokratiją teisminės valdžios veikioje. Ar teismų sistemos reforma, tiksliau jos norminės dalies kūrimas, sudaro sąlygas įtvirtinti teismo nepriklausomumą bei savarankiškumą? Koks sąvokos „teisėjo nepriklausomumas" turinys ir apskritai ką ji reiškia? Gal tai tiesiog teisinė fikcija arba abstrakcija, kuri gali būti įvairiai suvokiama ir interpretuojama? Pagaliau, gal tai tik teisės doktrinai patraukli sąvoka, kurios negalima pritaikyti praktiškai? Pastebime, kad teismo ir teisėjo nepriklausomumas, nors yra tapęs universalus, tačiau labai trapus ir praktikoje neretai pažeidžiamas principas. Teismo ir teisėjo nepriklausomumo kai kuriuos aspektus norėtume aptarti kartu gvildendami teismo teisę savarankiškai, kitų valstybės valdžių nevaržomam tvarkytis ir kartu prisiimti visišką atsakomybe už efektyvų teismų sistemos (norisi vengti žodžio „valdžios") funkcionavimą. Straipsnyje pateikiama keletas sąvokų, dėl kurių, žinoma, galima būtų diskutuoti, Apie teismų savivaldy Lietuvoje kalbama kol kas nedrąsiai. Galėjimas laisvai disponuoti tiesiogiai iš biudžeto skiriamais asignavimais yra pirmas žingsnis teismo savarankiškumo link. Kita vertus, esame įsitikinę, kad teismo ir teisėjo nepriklausomumas tol nebus visavertis, kol teismų organizacinė veikla nebus patikėta jiems patiems, Bandysime atskleisti, ką reiškia teismų savivalda ir pagristi teiginį kad teismo nepriklausomumą garantuoja veiksmingai funkcionuojanti, demokratiniu būdu suformuota teismų savivaldos ir savireguliacijos sistema
