SANKSI BAGI MILITER YANG MELAKUKAN TINDAK PIDANA PERZINAHAN DI WILAYAH HUKUM PENGADILAN MILITER II-11 YOGYAKARTA

The title of this legal research is The Sanctions For Military Members Who Committed Acts of Adultery In The Territory of Military Court II-11 in Yogyakarta. The background of this research is the fact that there are still many of Indonesian National Army members who commit violations in carrying out their duties and obligations, This research uses normative research methods, where the focus of this study is the applicable legal norms. Normative legal writing uses secondary data consisting of primary legal materials, secondary legal materials, and tertiary legal materials. The primary legal material is a statutory, consisting of the Penal Code, the Criminal Code of the Military, and Act Number 31/1997 on Military Court. The secondary law material, tertiary legal material or also known as non-legal material is a dictionary and an encyclopedia. Based on the research that has been done it can be drawn two conclusions, first the sanctions imposed on members of the military committing adultery shall be imprisonment for 5 months, as provided in article 284 of the Penal Code. Second, judge of the Military Court II-11 Yogyakarta in imposing sanctions on members committing adultery is based on juridical and non-juridical considerations.
