Pour une pleine constitutionnalisation et un enrichissement normatif de la Charte des droits et libertés de la personne

To continue the pionnering work of Jacques-Yvan Morin who had noted in 1987 “ the gradual entrenchment of the Québec Charter of Rights and Freedoms”, Professor Daniel Turp outlines the measures that could be taken to ensure the full entrenchment and normative enhancement of the Quebec Charter, which Professor Morin also called his wishes. To this end, it is thus proposed to adopt a special procedure of revision of the Quebec Charter and to extend its supremacy to all fundamental rights it guarantees. Suggestions are also made to achieve a normative enrichment of the Quebec Charter by providing for the inclusion of new rights for individuals but also for communities, and in particular new economic, social, cultural and linguistic rights. Stripped of an institutional framework that weighs unduly on the Charter and makes it lose its style as a basic law, the text of a new Quebec Charter of Fundamental Rights is presented to address not only the expectations expressed by Jacques-Yvan Morin during the drafting the Québec Charter of Rights and Freedoms, but also by all those who interpreted and applied the Charter since its adoption in 1975. Professor Turp expresses the hope that a new Quebec Charter of Fundamental Rights will be included or incorporated by reference in a Québec constitution. The author recalls that he proposed to follow such an path in several textes of a Québec constitution he drafted and believes that Professor Jacques-Yvan Morin would also appreciate to see the first Québec constitution confer a prominent place to fundamental rights. If this proposal became a reality one day, a tribute would be paid to Jacques-Yvan Morin, a great constitutional patriot who served so generously, throughout his whole life, the people and the State of Québec.Afin de poursuivre le travail du pionnier de Jacques-Yvan Morin qui avait constaté en 1987 «la constitutionnalisation progressive de la Charte des droits et libertés de personne » , le professeur Daniel Turp esquisse les mesures qui pourraient être prises pour assurer la pleine constitutionnalisation et l’enrichissement normatif de la Charte québécoise, ce que le professeur Morin appelait aussi de ses voeux. Ainsi, il est proposé d’adopter à cette fin une procédure spéciale de révision de la Charte québécoise et d’étendre sa suprématie à l’ensemble des droits fondamentaux qu’elle garantit. Des propositions sont par ailleurs formulées pour réaliser un enrichissement normatif de la Charte québécoise en prévoyant l’inclusion de nouveaux droits pour les personnes, mais également pour les collectivités et, en particulier, des nouveaux droits économiques, sociaux, culturels et linguistiques. Dépouillée d’un dispositif institutionnel qui l’alourdit indûment et lui fait perdre son allure «fondamentale » , le texte d’une nouvelle Charte québécoise des droits fondamentaux est présenté afin de combler non seulement les attentes exprimées par Jacques-Yvan Morin lors de l’élaboration de la Charte des droits et libertés de la personne, mais aussi toutes celles et ceux qui l’ont interprétée et appliquée depuis. Le professeur Turp formule en outre l’espoir qu’une nouvelle Charte québécoise des droits fondamentaux soit un jour intégrée ou incorporée par renvoi dans une constitution québécoise. L’auteur rappelle qu’il a proposé d’emprunter une telle avenue dans les projets de constitution québécoise qu’il a rédigés et est d’avis que le professeur Jacques-Yvan Morin aimerait sans doute que la première constitution québécoise réserve une place de choix aux droits fondamentaux. Si une telle proposition devenait un jour une réalité, un hommage serait ainsi rendu à ce grand patriote constitutionnel Jacques-Yvan Morin qui a si bien servi, tout au long de sa vie, le peuple et l’État du Québec.Turp Daniel.
