L'ADMINISTRATION PENITENTIAIRE FRANÇAISE ET L'ARTICLE 3 DE LA CONVENTION EUROPEENNE DES DROITS DE L'HOMME : ETUDE DU PROCESSUS DE « RECEPTION ADMINISTRATIVE » DE LA NORME SUPRANATIONALE

The reception here understood as the acknowledgment of the obligatory nature of the norm by the system which it is meant for of the norm contained in article 3 of the European Convention on Human Rights by prison administration isn't automatic. Administrative action can't be reduced to a simple functional translation of the rule of law . A valid juridical text, in a Kelsenian meaning whereas it is highly symbolic as article 3 of the European Convention on Human Rights is isn't acknowledged as restricting by the prison administration from the only fact it belongs to a positively valid juridical system. Reception of external norm by administration depends on several complex operations very linked up : on the one hand, mediations processes, and on the other, an administrative transposition process. Hard obstacles to reception of the norm can be revealed. Thus, a juridical text only can gain a normative signification for the system which it is meant for in an administrative sociology of law view which tends to cease administrative processes occurring in norm production by a reception process which reveals administrative construction of juridicity of a text. Prison administration becomes a representative reflection of administration, and the study of reception process of supranational norm by this administration can show with acuteness, general administrative phenomenon.La réception entendue ici comme la reconnaissance du caractère obligatoire de la norme par le système auquel elle est destinée de la norme contenue dans l'article 3 de la Convention européenne des droits de l'homme par l'administration pénitentiaire n'est pas automatique : l'action administrative ne peut se réduire à la simple traduction fonctionnelle du principe de légalité. Un texte juridique valide, au sens kelsenien du terme même hautement symbolique comme l'est l'article 3 de la Convention européenne des droits de l'homme n'est pas reconnu comme contraignant par l'administration pénitentiaire du simple fait de son existence au sein d'un système juridique positivement valide. La réception de la norme externe par cette administration dépend d'opérations complexes étroitement liées les unes aux autres : des opérations de médiations, d'une part, et une opération de transposition administrative, d'autre part. Des obstacles forts à la réception de la norme peuvent d'ailleurs être mis en évidence. Ainsi, un texte juridique n'est susceptible d'acquérir une signification normative pour le système auquel il est destiné, et ce dans une perspective de "sociologie administrative du droit" visant à saisir les processus administratifs à l'oeuvre dans la production de la norme, qu'au terme d'un processus de réception, mettant en évidence la construction administrative de la juridicité d'un texte. L'administration pénitentiaire devient le reflet représentatif de l'administration, et l'étude du processus de réception de la norme supranationale par cette administration permet de montrer, avec une particulière acuité, des phénomènes administratifs généraux
