Pertanggungjawaban Anggota Militer yang Melakukan Tindak Pidana Kesusilaan di Pengadilan Militer II-11 Yogyakarta

This Legal Research is titled Accountability of Military Members Conducting Criminal Acts (Case Study of Pengadilan Militer II-11 Yogyakarta dalam Putusan Nomor: 15 - K / PM II 11 / AD / II / 2014) compiled by Cicilia Retno Ayuningtyas NIM 130511258. This research uses Normative Juridical Research Methodology which aims to determine whether the form of accountability for military personnel who commit immoral crimes according to Putusan Nomor No. 15 - K / PM II 11 / AD / II / 2014 and aims to find out whether there are obstacles faced by military prosecutors in Implementation of Putusan Nomor: 15 - K / PM II 11 / AD / II / 2014. This research was conducted by approach of legislation. The data used are secondary data covering literature study in the form of primary law material namely Kitab Undang-Undang Hukum Pidana dan Kitab Undang-Undang Hukum Acara Pidana, Kitab Undang-Undang Hukum Pidana Militer, Kitab Undang-Undang Disiplin Militer, Undang-Undang Nomor 31 Tahun 1997 tentang Peradilan Militer. The second is secondary legal materials in the form of law books, tertiary legal materials in the form of legal dictionary. Data analysis used is deductive and qualitative analysis. Based on the result of the research, it can be concluded: 1) The form of accountability for military members who commit immoral crime according to Putusan Nomor: 15 - K / PM II 11 / AD / II / 2014 namely Juridical Accountability That Defendant is guilty of committing crime violating morality and shall be imprisoned under pasal 281 ke-1 Kitab Undang-Undang Hukum Pidana and shall not be subject to Administrative Accountability, such as demotion or dismissal is not found. 2) The obstacle experienced by the military prosecutor in the implementation of Putusan Nomor: 15 - K / PM II 11 / AD / II / 2014 is absent because the Defendant has been showing good behavior which ultimately eases the punishment
