SANKSI PIDANA TERHADAP KELUARGA KORBAN KEJAHATAN YANG TIDAK MENGIZINKAN DILAKUKAN OTOPSI

The title of undergraduate thesis is the Criminal Sanction suit for Victim’s Familiy of Crime Who Do Not Allow to Autopsy. This study aims to Know the criminal sanction for the victim’s familiy of crime who do not allow to autopsy and the factors of the victim's family who do not allow to autopsy. This undergraduate thesis uses Normative research method. The result of this study is the Regulation of Criminal Sanction for Victim’s Familiy can be applied Article 222 of the Criminal Code. If in this case, autopsy is urgent and the victim's family refuses, the victim's family can be punished by Article 222 of the Criminal Code, but if the autopsy is not urgent and it is not relation with the the customs and Islamic law, they can to refuse the autopsy. There are severals factor can not be allowed to autopsy by the victim's family, that are the prohibition of Islam perpespective and the existence of belief
