Le droit au logement

Since the period following World War II, housing has no longer been considered a mere need but more a right which citizens may claim from authorities. In France, this right was first acknowledged in a legislative text dating back to 1982. Although still in the process of being conceptualized, the notion of the right to housing is now a juridical reality. it stands in the area where private and public law converge. seen from the aspect of private law, though the right to housing does not fit the usual pattern of subjective rights, it may yet be considered an individual prerogative under private law, owing to the protective measures it offers to those who benefit from it. From the public law aspect, it is both a social right and a public privilege. Considered a goal of constitutional value by the constitutional council, the implementation of this right mobilizes public authorities as well as private citizensÀ partir de la période qui a succédé a la deuxième guerre mondiale, le logement n'est plus considéré uniquement comme un besoin, mais surtout comme un droit que les citoyens peuvent réclamer aux pouvoirs publics. En France, la reconnaissance de ce droit dans un texte législatif date de 1982. Bien qu'en voie de conceptualisation, la notion du droit au logement est aujourd'hui une réalité juridique. Elle se trouve à la convergence du droit privé et du droit public. Du point de vue du droit privé, même s'il ne correspond pas au schéma classique des droits subjectifs, par les mesures de protection qu'il offre à ses bénéficiaires, le droit au logement peut être considéré comme une prérogative individuelle de droit privé. Du point de vue du droit public, il se présente à la fois comme un droit social et comme une liberté publique. Considéré par le conseil constitutionnel comme un objectif de valeur constitutionnelle, sa mise en œuvre mobilise aussi bien les pouvoirs publics que les personnes privée
