Relaciones entre el arte y los derechos humanos

This article aims to reflect briefly about the connection between art and human rights, taking into account the origin or provenance of the explanation of art. For consequence, we consider three types of work: 1. Works originating in a judicial or State decision as ameans of redress for victims; 2. Works of art from the artists own initiative, and, 3. Artworks or performing art practices performing victims who have suffered violations of their human rights. This text, by considering that the works of art or artistic practices related to human rights, have different objectives depending on their origin. It argues that the state is to compensate victims and help with the guarantee of non-repetition, meanwhile the artists to express their sensitivity in relation to a specific topic that interests them to touch on a subject, and victims are mechanisms of resistance and denunciation which enable to move the individual trauma to the formation of collective entities with the capacity to influence social conditions leading to the violation of their Human Rights. To think about the issue, some judgments are touched on a subject of the System IDH and artistic works, art practices of victims of the Colombian armed conflict.Este artículo se propone reflexionar sumariamente acerca de la vinculación entre el arte y los derechos humanos, teniendo en cuenta el origen o proveniencia de las manifestaciones artísticas. Para el efecto, se consideran tres tipos de obras: 1. Obras originadas en una decisión judicial o estatal como medio de reparación a las víctimas; 2. Obras de arte provenientes de la propia iniciativa de los artistas, y 3. Obras o prácticas artísticas que realizan las víctimas que han sufrido violaciones a sus derechos humanos. Este texto parte de considerar que las obras de arte o las prácticas artísticas, relacionadas con los derechos humanos, tienen objetivos diferentes según sea su origen. Se plantea que el fin del Estado es reparar a las víctimas y contribuir con la garantía de no repetición; mientras que el fin de los artistas es manifestar su sensibilidad en relación con un tema específico que les interesa abordar; y para las víctimas, son mecanismos de resistencia y denuncia que permiten pasar del trauma individual a la conformación de sujetos colectivos con capacidad para incidir en las condiciones sociales que generan la violación a sus derechos humanos. Para pensar el tema, se abordan algunas sentencias del Sistema Interamericano de Derechos Humanos, y obras y prácticas artísticas de víctimas del conflicto armado colombiano
