About compulsory licensing: an approach to international and administrative law

El presente artículo discurre primero, sobre los fundamentos internacionales de la Propiedad Intelectual y, segundo, sobre la licencia obligatoria. Ésta es abordada en términos del derecho constitucional y administrativo brasileños. El objetivo es demostrar que la concesión de la licencia obligatoria es ejecutada como acto político (en el sentido peyorativo) sin respeto al orden jurídico que impone requisitos para la concesión; requisitos que buscan proteger el propio derecho de propiedad y libre iniciativa, y por lo tanto merecedores de protección legal.50-86plcarvalho@yahoo.com.brThe present article initially discusses the international foundations for Intellectual Property and then takes on obligatory licensing. The latter is approached under the terms of Brazilian administrative and constitutional law. The objective is to show that granting compulsory licenses is presently executed as a political act (in the pejorative sense) disregarding judicial order which imposes requisites for the licensing, with the intention to protect free initiative and the proprietary right itself thus deserving legal protection
