Along with economic development, there are various forms of collateral used in the field of civil relationship and has been set in the civil law one of them is fiduciary. Fiduciary as an actual security institutions is not new, but it has long been used in the business world, both in Indonesia and in other developed countries with different variations. This research aims to lift the fiduciary birth history from the standpoint of practical needs and its development in Indonesia. The method used in this research is a historical juridical. Results of this research is the formation of fiduciary institution that grows in practice because there needs to be a guarantee institution material for moving objects in the form of venture capital items. History fiduciary developments in Indonesia, was influenced by the urgent needs of the small businesses that need credit facilities for its business, because there is a shortage of institutions liens or mortgages version of the Civil Code or other laws
