Efektifitas Hibah Hak Atas Tanah Menurut Hukum Adat dalam Pendaftaran Tanah di Kabupaten Boyolali

Grant is one of many ways to transfer land rights of the holder of the right to exclude others with just free. Under the terms of the law the Land, then the mandatory registration of transfer of rights to the Land's office issued a certificate as a guarantee of legal certainty and legal protection for rights holders on their grant legal actions undertaken. Research is using juridical empirical approach is carried out in the district of Boyolali Regency by taking samples in the Village Mojolegi and Village Sudimoro, with specification of research descriptive, with the population studied is the relevant parties that do grant, among others, the Notary / PPAT, Land Office, in particular section Land Rights and Land Registration and citizens that the village head. The survey results revealed that the factors which is why there are still people who use the grants are Indigenous and do not use PPAT, due to ignorance, the issue of cost and the strong role of the village head in the process of transfer of rights over land (grants) .In the law that grants do customarily is a legitimate legal act, but not legally prove their grant legal act formally required in the provision of land registration. Transfer of land rights can only be registered if it is evidenced by the PPAT deed that serves as proof that the right has made the relevant legal acts, and in this respect grant. The conclusion of this study, that the grant Indigenous although legally valid customary but cannot be used as a condition for registration of land without artificial deed of grant, so the grant is customary must be equipped with a certificate PPAT by way of the parties facing PPAT, as a precondition for registration of land for grants, so the grants are not effective in the registration of customary land
