PERSEPSI MASYARAKAT TERHADAP PENEGAKAN HUKUM LINGKUNGAN DI KOTA SEMARANG (PEOPLE'S PERCEPTION AGAINST ENVIRONMENTAL LAW ENFORCEMENT IN SEMARANG CITY)

Every person has the rights for a good and healthy environment, and has the responsibilities to preserve the living environment and to prevent and overcome the pollutions and its damage. Therefore for those whom cause damage and/or pollution to the environment could be punished. This has been arranged in the section No.20 and 22 act No 4/1982. The damage of living environment nowadays is mostly caused by the ineffective and inefficient management system. Therefore the aim of the living environment management is to form up a more effective and efficient organization, from the top level to the regions, whether it's inside the government circles, business, or the society's organization. These aims cover the forms of institution in the living environment funding system, the executor institution and monitoring, and information system, also its social communication. With an effective management system, participation from the society is expected to be rising in the developing of living environment. Participation of the society is one of main factors to the success of the effort of controlling and preservation of the environment, but there is still lack of the community's participation. Besides, the government's policy in handling the violation by giving priority to the education rather than give the punishment cause the subject to consider the environmental• pollution of no importance. The lack of firm of the government is oftenly used to break the law. Considering the perception of the society is a social contribution that is a picture created by actors of society's member against a certain phenomenon of an interaction occurred in certain contexts, so a crime or not a crime depends on the person looking at the problem. Considering the problems we are dealing with above, it is important to study the society's perception against the environmental law enforcement. In this study there are some problems; one of them is how is the people's perception against the law enforcement, and its wishes and the influence of political structure, economics, social, culture, against the environmental law enforcement in Semarang city. The study is done with the qualitative approach, which is chosen because it is expected that through this approach, descriptive data could be gained in the form of written or targeted word from the people and the actor which is surveyed. In the matter the behaviors of the society and the law enforcement instrument have a great role. From the study, these matters were encountered: I. Society's knowledge when they interact with their environment which is when they received inputs from the research centre. The stimulus given by the research centre causes the society to respond and report it to the related institute. Also with their knowledge of environmental law enforcement, they gained the knowledge from their interaction with the environment while they were doing negotiation with the government. From this negotiation then it could give judgment or perception that the law enforcement has not reflect justice, but only gives benefits to one party. 2. Common people perception (industry) to the environment are various, people dumping waste over the limited grade is considered a crime, while some considered it common, because the community consider the river is a site to dump all kind of waste. The perception of community (industry) against the law upholding also various. Somc prefer to solve the problem by the formal institute, some prefer through discussions. The local government consider these breaking of the law does not have to be punished with the criminal law, but could be solved by government's two steps policy: The first step is collecting data and analysis of the activity, the effect and pollution level, and the second step start with the handle of the quarrel then continued with the recovery of its natural resources, done by handing over the warning or signing superkasih through prokasih project, then routine observation is conducted. The police, judge and attorney agreed to use the criminal law when the activity proven to be polluting, only the coordination between the related institute is needed, which has not done all this time. 3. The influence of political, social, economical, and cultural structure against the law enforcement of environment in Semarang city is significant. This is as the result of there is no true will of the local government to hand over the pollution cases to court considering the development, such as improving the job opportunity, increasing the local government revenue etc. Setiap orang berhak atas lingkungan hidup yang baik dart sehat, serta berkewajiban memelihara lingkungan hidup dan mencegah serta mdnanggulangi kerusakan dan pencetnarannya. Maka barangsiapa merus dan/atau mencemarkan lingkungan hidup dapat dikenakan sanksi. Hal int tegas-tegas diatur dalam pasal 20 dan pasal 22 UU No. 4 tahun 1982. Pada waktu ini kerusakan lingkungan hidup seringkali disebabkan oleh sistem pengelolaan yang belum efektif dan efisien. Oleh karena itu sasaran pengelolaan l.ingkungan hidup adalah terbentuk ya sistem kelembagaan yang lebih efisien dan efektif, mulai dad tingkat usat sampai ke daerah, baik dalam ]ingkungan pemerintah, dunia us a maupun organisasi masyarakat, sasaran ini mencakup terbentuknya elembagaan dalam sistem pembiayaan lingkungan hidup, organisasi pelak ananya dan pengawasan, dan sistem informasi, serta komunikasi sosial/ya. Dengan sistem pcngelolaan yang efektif diharapkan peran serta masyarakat dalam pembangunan lingkungan hidup akan rneningkat. Peran serta masyarakat merupakan salah satu syarat utama bagi keberhasilan usaha pmgendalian dan pelestarian lingkungan, namun demikian peran serta rnasyar kat rendah. Disamping itu adanya kebijaksanaan dad pemerintah dalam menangani pelanggaran dengan mengutamakan pembinaan dan pemilihan lingkungan dart pada menjatuhkan sanksi menyebabkan pelanggar t eremehkan masalah pencemaran lingkungan. Kekurangtegasan pemerinta ini sering disalahgunakan untuk melakukan pelanggaran. Mengingat persepsi masyarakat adalah suatu kontribusi Isosial yaitu suatu gambaran yang diciptakan oleh pelaku anggota masyaraltat terhadap fenomena tertentu atas suatu interaksi yang terjadi dalam kont ks tertentu, maka kejahatan/bukan adalah melekat pada orang yang melihatn a. Berdasarkan hal tersebut di atas, maka menjadi pe ting untuk mengkaji rnasalah persepsi masyarakat terhadap penega an hukum lingkungan. Dalam kajian ini diajukan beberapa masalah, sa ah satunya bagaimana persepsi masyarakat terhadap penegakan hukum lingkungan serta kehendak-kehendaknya dan giagaimana pengaruh kondisi struktur politik, ekonomi, sosial, budaya, terhadap penegakan hukum lingkungan di kota Semarang. Penelitian ini dilakukan dengan menggunakan pendekatan kualitatif, dipilih karena melalui pendekatan ini diharapkan dapat dih isilkan data deskriptif berupa kata-kata tertulis/lesan dart orang dan, pe ilaku yang diamati. Dalam hal ini perilaku dad masyarakat dan aparat pen gak hukum yang mempunyai peran. Dari penelitian dijumpai beberapa hal-hal sebagai berikut : 1. Pengetahuan masyarakat mengenai pencemaran lingkungan ketika mereka berinteraksi dengan lingkungannya yaitu ketika mereka memperoleh masukan dad Balai Penelitian. Rangsangan yang diberikan oleh Balai Penelitian menyebabkan masyarakat melakukan respon dan melaporkannya kepada instansi terkait. Begitu juga pengetahuan mereka tentang penegakan hukum lingkungan juga didapat dad interaksinya dengan lingkungan, pada waktu melakukan perundingan dengan aparat pemerintah. Dart hasil perundingan ini kemudian dapat memberikan penilaian/mempersepsikan bahwa penegakan hukum lingkungan tidak mencerminkan keadilan, melainkan menguntungkan salah satu pihak. 2. Persepsi masyarakat umum (industri) terhadap lingkungan justru bervariasi, masyarakat membuang limbah melebihi baku mutu lingkungan dianggap kejahatan, ada yang menganggap itu hal biasa, karena masyarakat menganggap sungai adalah tempat untuk membuang segala macam kotoran. Persepsi masyarakat (industri) terhadap penegakan hukum lingkungan juga bervariasi. Ada yang lebih menyukai diselesaikan di lembaga resmi, ada pula yang setuju dengan musyawarah. Pihak Pemda menganggap bahwa kasus pencemaran lingkungan tidak harus dikcnakan sank si pidana, melainkan masih ditoleransi untuk diselesaikan dengan kebijakan pemerintah dengan dua tahap : Tahap pertama pendataan dan analisis mengenai kegiatan, dampak dan tingkat pencemarannya dan tahap kedua dimulai dengan penanganan sengketa kemudian dilanjutkan dengan perbaikan sumberdaya alamnya, dilakukan dengan memberikan Surat Peringatan atau penandatanganan Superkasih melalui proyek Prokasih, kemudian dilakukan pemantauan rutin. Pihak Polisi, Jaksa, Hakim setuju untuk menggunakan sanksi pidana asal perbuatannya betul-betul terbukti pencemaran, hanya saja menurut mereka perlu ada koordinasi antar instansi terkait, yang selama ini koordinasi dalam pelimpahan kasus belum pernah dilakukan. 3. Pengaruh kondisi struktur politik, sosial, ekonomi, budaya terhadap penegakan hukum lingkungan di kota Semarang sangat besar. Hal ini merupakan dad tidak adanya kemauan yang sungguh-sungguh dari. Pemda untuk melimpahkan kasus pencemaran lingkungan ke pengadilan atas dasar pertimbangan pembangunan, seperti memperluas lapangan kerja, menambah pendapatan Pemda dan sebagainya
