CRIMINAL PROCEEDINGS PROBLEMS OF SEIZURE OF PROPERTY

Aresta uzlikšanas mantai institūts nekad nav zaudējis savu aktualitāti, tomēr kriminālprocesā vairākkārt veiktie grozījumi nav pilnībā novērsuši nepilnības Kriminālprocesa likuma 28. nodaļā, kā arī praksē pastāvošos problēmjautājumus saistībā ar aresta uzlikšanu mantai kriminālprocesā. Mūsdienās mantisko jautājumu risināšana kriminālprocesos kļūst arvien aktuālāka, tāpēc ir svarīgi, lai tie tiktu risinātu efektīvi, ievērojot samērīgumu un prettiesiski neierobežotu personas tiesības uz īpašumu. Maģistra darba izstrādes laikā tika izpētīts aresta uzlikšanas mantai kriminālprocesuālais regulējumu un izzinātas tā piemērošanas problēmas, rasti iespējamie to risinājumi un secināts, ka Kriminālprocesa likumā ir jāiekļauj kārtība un kritēriji pēc kādiem tiek vērtēta mantas vērtība; pēc kādiem procesa virzītājs pārbauda personas likumīgos ienākumus, kā arī pēc kādiem tiek vērtēta mantas vērtības samērīgums attiecībā pret personas likumīgajiem ienākumiem. Maģistra darbs sastāv no 70 lapām, 4 nodaļām, 10 apakšnodaļām, nobeiguma un 2 pielikumiem.The Master's thesis will deal with the problems in criminal proceedings related to the seizure of property. The institute of seizure of property has never lost its relevance, however, the repeated amendments made to the Criminal Procedure have not completely eliminated the shortcomings in Chapter 28 of the Criminal Procedure Law, as well as the problems in practice related to the seizure of property in criminal proceedings. Nowadays, resolving property issues in criminal proceedings is becoming more and more important, so it is important that they are resolved effectively, respecting proportionality and not unlawfully restricting a persons right to property. During the elaboration of the master's thesis, the criminal procedural regulation of seizure of property was searched and the problems of its application were explored, possible solutions were concluded and it was concluded that the procedure and criteria according to which the value of property is assessed should be included in the Criminal Procedure Law; according to which the person conducting the proceedings checks the legal income of the person, as well as according to which the proportionality of the value of the property in relation to the legal income of the persons is assessed. The Master's thesis consists of 70 pages, 4 chapters, 10 subsections, a final and 2 appendices.
