Leagal proctection of persons, whose interests have been affected by proceedings of criminally acquired property

Ar starptautiskiem un Eiropas līmeņa institūciju regulējumiem un ieteikumiem Latvijā ir panāktas noziedzīgi iegūtas mantas normatīvo aktu izmaiņas, kuras būtiski mainījušas tiesu praksi. Šo izmaiņu rezultātā ir radusies nepieciešamība pēc jaunas, vienotas regulējuma izpratnes izveides. Šis ir sākums noziedzīgi iegūtas mantas izcelsmes pierādīšanas procesa efektivitātes un procesā iesaistīto personu tiesiskās aizsardzības mehānisma uzlabošanai. Darbā konstatētas esošas un iespējamas problēmas noziedzīgi iegūtas mantas regulējumā. Tiek paplašināti vērtētas personas, kurām pašlaik kriminālprocesā netiek nodrošinātas tiesības aizsargāt savas intereses. Autors sniedzis savu viedokli par normatīvā regulējuma efektivitāti, kā arī sniedzis priekšlikumus efektīvāka un pilnīgāka normatīvā regulējuma sasniegšanai.Due to international and European Union institution regulations and recommendations, Latvia has achieved changes in regulations of criminally acquired property, which have significantly modified states case law. Because on these changes, a better, unified understanding of this regulation must be established. It is the beginning for making the process of criminally acquired property more efficient and improving the defense mechanism of persons involved in the process. This Thesis identifies existing and possible problems in the process of criminally acquired property. Extended approach is devoted to persons, who are not fully provided with defense mechanisms of their interests. Author gives his opinion about the efficiency of regulation as well as give suggestion for improvements that would make it more fulfilled
