Utopia in the dock: the legitimacy of the IWA through the judicial process to strikers from Cocentaina (Valencia, Spain) in the 1870s

La singular persistencia del anarquismo en España ha sido atribuida al mesianismo del movimiento obrero local y al arcaísmo de su ideología. Pero si existe un hilo conductor que conecta Jerez, Montjuïc, la Mano Negra y Casas Viejas, incluso mayo del 37 con la sala Scala, es sin duda una acción policial y judicial abusiva e indiscriminada. El pernicioso cóctel de la represión y la incapacidad jalona la tormentosa relación del ideario libertario con el Estado. La historia, sin embargo, bien pudo ser otra. Existió una alternativa en los albores del internacionalismo que hubiese evitado el choque de trenes. Una opción sostenida jurídicamente en los tribunales por magistrados, fiscales y letrados, como Miguel Zorrilla, Eugenio Díez o Agustí Sardà. Una huelga de obreros papeleros en Cocentaina puso a prueba la sinceridad del derecho a asociarse, reconocido en la Constitución de 1869. There was an alternative at the dawn of Internationalism that could have prevented the train wreck; a legal alternative supported in court by magistrates, prosecutors and lawyers such as Miguel Zorrilla, Eugenio Díez or Agustí Sardà. A strike by paper workers in Cocentaina tested the authenticity of the right to freedom of association, recognized in the Constitution of 1869.
