Gendered laws of war

1914-2014 : in this centenary year, Clio, Femmes, Genre, Histoire focuses on other conflicts. Since the late 20th century, the study of conflict has been revitalized by new approaches : on one hand, anthropological analysis of the phenomenon of war, with special attention to private life, on the other a new focus on what happens as a war comes to an end. Moreover the war in former Yugoslavia, and the genocide of the Tutsis in Rwanda have led to the setting up of international tribunals (the ICTY in 1993 and the ICTR a year later.) Questions such as the condemnation of sexual violence in wartime and the protection of civilian populations have taken on an increasingly high profile at international level, giving rise to new research. Since the end of World War II, violence against women and a growing awareness that both sexes are implicated in military matters have become a fluctuating indicator of «the laws of war». 1914-2014 : en cette année de centenaire, Clio, Femmes, Genre, Histoire portera son regard sur d’autres conflits. Depuis la fin du XXe siècle, leur étude a été renouvelée, d’un côté par une approche anthropologique du fait guerrier et une attention portée à l’intime, de l’autre par la focale mise sur les sorties de guerre. Par ailleurs, la guerre dans l’ex-Yougoslavie, puis le génocide des Tutsis au Rwanda, ont abouti à la constitution de tribunaux internationaux, le TPIY en 1993 puis le TPIR un an plus tard. La dénonciation de la violence sexuelle et la protection des populations civiles ont été de plus en plus prises en compte au niveau international et ces questions ont attiré l’attention des chercheurs. Ainsi, depuis la fin de la Seconde Guerre mondiale, les violences faites aux femmes et la mixité croissante de la sphère militaire ont constitué un marqueur fluctuant de ce que l’on dénomme « les lois de la guerre »
