La política en materia de medio ambiente de la unión europea en perspectiva histórica: De roma a niza.

The study sets out the historical-juridical panorama that has based the action of the European Communities, now European Union, in the environmental field from its origins until the Treaty of Nice has ceased to be in force. In this sense, in a clear manifestation of the crystallization of European law in phases or in stages, the work shows how it has been passed from practically initial normative silence to the regulation established in Nice, pointing out the various contributions to this issue that have made the successive treaties that since the fifties of the last century have been conforming the so-called “primary law” , particularly focusing on the conventional instrument and its subsequent developments that in the start of the community building it served to create the then European Economic Community.El estudio expone el panorama histórico-jurídico que ha fundamentado la acción de las Comunidades Europeas, hoy Unión Europea, en el ámbito medioambiental desde sus orígenes hasta que el Tratado de Niza ha dejado de estar vigente. En este sentido, en una clara manifestación de cristalización del Derecho europeo por fases o por etapas, el trabajo pone de manifiesto cómo se ha pasado desde el prácticamente silencio normativo inicial hasta la regulación establecida en Niza, señalando las diversas aportaciones a esta cuestión que han hecho los sucesivos tratados que desde los años cincuenta del siglo pasado han venido conformando el llamado “Derecho primario” , particularmente centrándose en el instrumento convencional y sus posteriores desarrollos que en el inicio de la construcción comunitaria sirvió para crear la entonces Comunidad Económica Europea
