PENGATURAN PERDAGANGAN PERBATASAN ANTARA INDONESIA –MALAYSIA DALAM KAITANNYA DENGAN PELAKSANAAN PERSETUJUAN WTO

This study is concerning with the regulation of Border Trade especially Indonesia and Malaysia in relation to the implementation of main purpose World Trade Organization which is to create liberalitation of the world trade with erasing trade barriers in tariff and non-tariff. In this legal writing, the researcher tries to examine and analyze from the main purpose ofthe Agreement Establishing of the World Trade Organization and quantitative restriction principle using normative legal research methods and literature.The data of this research was analized by deductiveand qualitative method. Based on the results of research and analysis, it can be concluded that based on main purpose World Trade Organization, the regulation of Border Trade between Indonesia and Malaysia is restricted for border society to fulfill their needs for living that is not aimed to inhibit the world trade. Based on quantitative restriction principle, the rules of the border trade which has requirement 600MYR each month is not such restriction to inhibit WTO purpose
