82/92 10. SUMMARY Řehořová, Barbora. DOMESTIC VIOLENCE - CRIMINAL ASPECTS The work presented here is attempting to outline the specific laws pertainingd to domestic violence. As mentioned previously, the aim of this work is to explore in detail the key laws and principles regarding domestic violence, and their legal definitions, distinguishing domestic violence from other violent acts suffered within the family. The key characteristics of domestic violence were outlined. It is appropriate to note here that domestic violence can be defined in such a broad spectrum of manifestations and these manifestations appear in many varied combinations. The second part of the work presented here attempts to specify the material and salient facts most commonly seen in domestic violence cases. Aggravating factors against the offender were also mentioned (aggrivated factors are the opposite of mitigating factors, if they can increase the severity of the crime and subsequently increase the length of any custodial sentence handed down by the presiding judge). Situations, where a victim of domestic violence themselves perpetrates a crime of domestic violence against another person, and thus herself becomes an offender, were also noted.
