Penentuan Harga Dalam Pemberian Ganti Kerugian Hak Atas Tanah Dan Atau Bangunan Dalam Pengadaan Tanah Untuk Pembangunan Jalan Tol (Studi Di Kelurahan Madyopuro Kota Malang)

Objective of this journal article is to discuss about legal issues associated with Pricing In Granting Rights to Land Compensation And Or building in Land Acquisition for Toll Road which is based on a determination of the value of price compensation is done unilaterally by the land procurement committee in Madyopuro village, Kedungkandang district, Malang city. The aim of this study is to understand and analyze the determination of the value of price compensation which is done unilaterally by the land procurement committee, without public discussion with the residents affected by the project land acquisition in the village Kedungkandang, Kedungkandang district, Malang. The method used in this thesis is empirical juridical legal research with a sociological juridical approach. Result discussion of this journal article is determination of price of compensation payment set by the Implementing the Land Acquisition (P2T) is under the supervision of the Institute of Land Malang based on the judgment of the assessment team (appraisal), for which citizens receive with the quotation of the designated resident told signatures to do the filing, and for those who do not agree obligation to file a lawsuit in the District Court of Malang. In this case, the land procurement committee did not bargain relevant amount of the value set price, whether it is fair or not, because it is possible there are errors in judgment against land acquisition object, it proved their value gap Hadi Mulyono prices on homes whose property was estimated Rp. 169.545.000,00 and Koemis Hendri home with estimated building prices Rp. 220.284.000,00. Furthermore, disparity occurs to house and shop Hj. Khodijah whose property was estimated Rp. 725.424.000 while Abdul Chamid house and shop whose property was estimated Rp. 1.375.433.900. Before P2T determining the price, they should in advance reviewing the fact on what the complaints of citizens affected, this is based on the principles of Audi et Lateram Partem or also known as the principle of balance, in order to achieve justice and prosperity for the people affected
