Kedudukan Anak Diluar Nikah Dalam Hak Mewarisi Ditinjau Dari Hukum Adat Gorontalo

The purpose of research To know and analyze the position of the child outside of marriage in the right to inherit in terms of customary law Gorontalo and to identify and analyze what factors affect a child outside of marriage can be inherited and can not inherit. The research methodology using the approach of legislation and case with this type of research is juridical empirical legal research. This study analyzed qualitative descriptive. The results of this study indicate that the resulting child outside of marriage can receive the inheritance if both parents are not mutually cursed each other, through the religious court of the child can gain clarity about who the biological parents of children making it easier to petition rights as the right to inherit.Factors affecting the child outside of marriage can be inherited and can not inherit among others, is to file a dispute to court religious, by registering the case, so that through the establishment of juvenile court may obtain the rights Mawaris. And can not be separated from nazab of his biological parents. While the factors that influence a child out of wedlock could not inherit is partly because both parents curse each other and do not recognize that the child is the biological son
