Pemenuhan Hak Saksi Dalam Perkara Pidana Pada Tahap Pemeriksaan Di Pengadilan

The purpose of this study was to determine the fulfillment of the rights of witnesses in criminal cases at the stage of examination in court. A witness had equal rights to protection, but in fact in the Criminal Code the right of a witness not clearly regulated but rather confirms the obligation of a witness. Lack of maximizing protection of the rights of a witness to the attention that is quite important, because it is supposed Institute Witness and Victim Protection established aims to provide protection to witnesses and victims in all stages of the criminal justice process in an environment of justice that the witness and the victim gets a sense of security in providing information on any criminal proceedings. The research method that used in this research was normative research method, which is focus with the regulations in accordance to examine consistence and synchronization of regulation implementation with the reality. The results of research there are still some difficulties experienced by the parties Law Enforcement is the authority implementing the Act Protection of Witness, the Witness Protection Agency and the victim was not in every area and the nature of the electorate, limitation of aid that can be given by law enforcement, the cost and the lack of a witness about his rights
