Остварување право на пензија врз основа на меѓународни договори за стаж остварен во странство

The open job market and the common exchange of work force between countries requires mutual regulation of rights and obligations from the field of the labor, pension and disability insurance, social security and etc. In order of realization of certain rights, Republic of Macedonia has concluded several international contracts in the field of pension and social insurance. The subject of this paper are the rights that can be realized according to the international contracts for social insurance which have been concluded by the Republic of Macedonia. The contracts elaborated in this paper are specific because of their time of conclusion, the rights and obligations that originate from them, the type of payment and etc. The contribution of this paper is the analysis of data that has not been elaborated so far, that is the number of realized rights of the international contracts for social insurance classified in several categories. The presented data is relevant, taken from the electronic system of the Fund for pension and disability insurance of the Republic of Macedonia as of 31 July 2014. The first chapter summarizes the historical development of the pension system in Republic of Macedonia. It contains the basic principles and foundations of the pension and disability insurance in Republic of Macedonia. In addition, it states out the countries that Republic of Macedonia has collaboration with, the countries that apply contracts inherited from former Yugoslavia, the countries with which are concluded contracts after the independence and countries with which Republic of Macedonia still has negotiations. The second chapter elaborates the Convention for social insurance between SFRY and Republic of Italy. This contract is interesting because it is the oldest international law contract of this area which is still actively applied. The contract has been concluded on 14 November 1957 and came into force on 01 January 1961. Another specification of this contract is that besides its application, it is not concluded directly between Republic of Macedonia and Republic of Italy but it is inherited from SFRY and later has been ratified by the Parliament of Republic of Macedonia. The third chapter analyzes the contract for social insurance between the Macedonian Government and the Government of the Federal Republic of Germany. This contract is an example of the differences between the legislation and the positive legal regulations from the area of social insurance in Republic of Macedonia and the countries in the European Union. The next chapter discusses the contract for social insurance between Republic of Macedonia and Republic of Croatia. The similarity between the pension systems of the countries contractors and the content of the norms of the contract are result of the common pension system which has been applied until the breakup of SFRY. The last contract analyzed in this paper is the contract for social insurance between the Government of Republic of Macedonia and the Government of Australia. This contract is the first contract concluded with transatlantic country, in which the pension system is based on principles that are different than those of the system of pension and disability insurance of Macedonia. From the aforementioned, thus, the paper includes conclusions and conceptual solutions in conclusion of new international contracts in the area of social insurance. In particular, it emphasizes the positive aspects of the analyzed contracts
