My aim in this paper is to justify the right of property as a fundamental right and to make its content explicit. Locke, Hegel, and Rawls are referred as established historical sources for this matter. Locke, with the thesis according to which labor is a foundation of property; Hegel, with the close bound between property and freedom; and Rawls, for having accounted freedom as a fundamental right that composes the first principle of his political conception of justice. I argue, therefore, that the right of property is an essential constitutional element
